Have you ever considered firing an employee due to a significant amount of absences?

Before you make any decision to fire, you should ask, “Why is this employee missing a lot of work?”  The answer to this is key because the employee’s reason might offer him or her protection under the Disability Act.

In Pennsylvania, you only need four employees to be regulated by the PA Human Relations Act and to be affected by the Americans with Disabilities Act As Amended (ADAAA) you only need 15 employees.

And if you have 50 or more employees, you are also regulated by the Family Medical Leave Act. 

A violation of the Disabilities Act or the Family Medical Leave Act can carry a fine in excess of $55,000 for the first offense and $110,000 for subsequent offenses.
